Terms of purchase, delivery and returns

This is a translation provided for convenience. In case of any discrepancy, the Lithuanian version prevails.

General provisions

1. These terms and conditions set out the mutual rights, obligations and liability of the buyer (the Buyer) and MB "Lynx Prekyba" (the Seller) when the Buyer purchases goods in the online shop www.lynxcannabis.lt.

1.1. These online shop rules (the Rules) are a legal document binding on the Buyer and the Seller. They define the rights and obligations of the Parties, the terms and procedure for buying goods, paying for them, delivery and returns, as well as other terms related to buying and selling goods in the online shop.
1.2. In these Rules, the Buyer is the person who buys in the online shop. The following may buy in the online shop:
1.2.1. a natural person with full legal capacity, i.e. an adult whose legal capacity has not been restricted by a court;
1.2.2. a legal entity.
1.3. By registering or placing an order, the Buyer unconditionally confirms that they have the right to buy in the online shop.
1.4. The Seller reserves the right to change, correct or supplement these Rules at any time. The Buyer is informed about changes on the online shop website. Changes take effect from the moment of publication for all transactions concluded after publication, so the Buyer is advised to read the Rules every time they shop.
1.5. The Seller is released from any liability if the Buyer has not read the Rules, in part or in full, although they were given the opportunity to do so.

A purchase is considered concluded when the Buyer, having filled the shopping cart in the online shop, provided all required details and paid (chosen to pay) the amount indicated by the Seller, receives an order (purchase) confirmation from the Seller at the email address provided. By placing an order, the Buyer is deemed to have read and unconditionally accepted these rules.

Ordering goods and concluding the contract

1. The Buyer can shop in the online shop 24 hours a day, 7 days a week.
2. Prices in the online shop and in the order are shown in euros, including VAT.
3. The delivery price is shown separately when the shopping cart is created.

Rights and obligations of the Buyer

1. In accordance with these rules and the laws of the Republic of Lithuania, the Buyer has the right to buy goods in the online shop.
2. If the details provided in the Buyer's account change, the Buyer must update them.
3. The Buyer has the right to return or exchange goods under the conditions set out in these rules.
4. If the Buyer attempts to harm the operation or stability of the online shop, the Seller may restrict, suspend (terminate) their access to the online shop without prior notice.

Rights and obligations of the Seller

1. The Seller has the right to suspend the online shop temporarily or indefinitely without separate notice.
2. To enable the Buyer to properly use the services of the online shop.
3. To arrange delivery of the goods ordered by the Buyer to the address specified by the Buyer.
4. If, due to important circumstances, the Seller cannot deliver the ordered goods, the Seller undertakes to offer the Buyer an equivalent product or to change the delivery time, and if the Buyer refuses, to refund the money paid by the Buyer within 3 business days.
5. The Seller has the right to cancel the Buyer's order without prior notice after 3 business days if the Buyer does not pay for the order within the specified time or does not provide the Seller with additional information needed to fulfil the order properly.
6. The Seller has the right to delete (block) the Buyer's account if incomplete, false or misleading information is provided.

Payment terms

1. The Buyer pays for the goods using one of the methods chosen when placing the order.
2. The order is processed, and the delivery time starts, only after the Seller's purchase confirmation is sent to the Buyer's email.

Delivery

1. Goods are delivered throughout Lithuania to parcel lockers by courier service.
2. The delivery price is shown in the Buyer's order.
3. Delivery times are shown in the order. The Buyer agrees that in exceptional cases delivery may be delayed due to unforeseen circumstances beyond the Seller's control. In that case the Seller undertakes to contact the Buyer immediately and agree on the delivery terms.
4. The Seller is released from liability for late delivery if the goods are not delivered or are delivered late through the fault of the Buyer or due to circumstances beyond the Seller's control.

Returns and exchanges

1. If the Buyer was sold a food product of inadequate quality, before the product's best before date has passed, the Buyer has the right, at their choice:
1.1. to demand that the product be replaced with the same product of adequate quality;
1.2. to have the price reduced accordingly;
1.3. to return the product to the seller and demand a refund of the money paid for it.

2. The Buyer may also exercise the rights set out in point 7 of these rules if they were sold a product whose best before date has passed.

3. Food products of inadequate quality are exchanged or returned at the place of purchase or at another place indicated by the seller that is convenient for the buyer. The Buyer submits a written request and the product to the seller. The request states the defects of the product and which of the requirements of these rules the Buyer has chosen. A receipt or another document confirming the purchase from this seller is attached to the request.

4. If the Buyer does not provide a receipt or another document confirming the purchase from this seller issued in the established manner, the product is exchanged or the Buyer's other requirements under these rules are fulfilled only with the seller's consent.

Final provisions

1. All disagreements arising from these rules are resolved through negotiation. If no agreement is reached, disagreements are resolved in accordance with the laws of the Republic of Lithuania.
2. Additions or changes to these rules take effect from the day of publication, i.e. from the day they are placed in the online shop system.
3. If the Buyer continues to use the services of the online shop after the rules are changed, the Buyer is deemed to accept the new version, partial changes or additions to the rules.
4. These rules do not limit the Buyer's rights under the laws of the Republic of Lithuania, including rights when buying a product or service of inadequate quality.
